This privacy policy describes which personal data we process when you visit our website, order from us, sell us a device, have a device repaired or write to us. It is based on the Federal Act on Data Protection (FADP) and the Data Protection Ordinance. For persons in Liechtenstein and the rest of the European Economic Area, the General Data Protection Regulation (GDPR) also applies, see section 13.

2. Visiting the website
When you access the website, our hosting provider processes technical data such as the IP address, date and time, the page accessed, the referring page, browser type and operating system. We need this data to deliver the website, find errors and fend off attacks. Our hosting provider automatically deletes the server logs after a short time.
To protect against spam and automated queries, we use our own check in the browser, without third-party services, and limit the number of requests. For this purpose, we generate an encrypted check value from the IP address.
We count page views without cookies and without third-party services. A check value that changes daily and cannot be reversed is generated from the IP address and the browser identifier. We do not store the IP address itself for this purpose. We store the page accessed, the referring page, the language and the screen width. We delete these figures after two years.
3. Orders and customer account
When you order, we process your name, billing and delivery address, e-mail address, telephone number if you provide it, the items ordered, prices, payment method and payment status, as well as your messages about the order. We need this data to conclude and perform the contract, ship the goods, handle returns and claims under the statutory warranty and our warranty, and fulfil our legal obligations, such as bookkeeping.
If you open a customer account, we also store your login details and your orders. You can have your account deleted at any time.
4. Buyback of devices
When you sell us a device, we process your details about the device, such as model, condition, accessories and serial number, your name, your address, e-mail address, telephone number if you provide it, and, for the payout, your IBAN and the account holder. We need this data for the offer, the Swiss Post shipping label, the inspection, the payout and bookkeeping, and to prevent the buyback of stolen devices. If there are indications of a criminal offence, we may pass data on to the police.
For details you enter yourself, such as game titles or a model, we use an AI service from OpenAI. It only receives this product text and a category, but neither your name nor your contact details. It identifies the product and estimates its market value in Switzerland. Please only enter details about the device in these fields, and no personal data. Section 15 explains how the instant price is calculated.
5. Repairs and gaming PCs
For a repair, we process your contact details, the details of the device and the problem, and the photos you send us. During the repair, it may be necessary to display data stored on the device or to reset the device. We only access your data to the extent necessary for the repair and testing, and we do not pass it on. For a gaming PC, we process your contact details, your requirements and the details needed for the quote and invoice.

If you write to us using a form or by e-mail, we process the information you give us in order to reply to you.
7. Cookies and local storage
We use technically necessary cookies and local storage in the browser so that the shop works, for example for the basket, checkout, login, spam protection and display in light or dark mode. On the checkout page, our payment service provider Stripe and the payment services offered there set cookies to process the payment and prevent fraud. If you choose another language on a page without its own translation, your browser stores this choice for one year in the cookie googtrans.
We do not set any other cookies. We do not currently use third-party analytics or advertising services.
8. Analytics and advertising
We do not currently use any third-party analytics or advertising services. Before we use such services, we will update this privacy policy and, where necessary, ask for your consent.
9. Recipients and service providers
We do not sell personal data. We only pass on data where this is necessary for the purposes mentioned, where the law requires it or where you have consented. The following service providers process data on our behalf or receive it under their own responsibility.
Swiss Post Ltd, Switzerland, receives your name and delivery address for shipping, and your e-mail address to announce the shipment. For a buyback, it receives your name and address for the shipping label.
Stripe Payments Europe Ltd., Ireland, handles the payments. Stripe processes some payment data under its own responsibility, for example to prevent fraud, and may transfer data to group companies in the USA. We do not receive full card details.
Klarna Bank AB, Sweden, receives your order and contact details if you pay with Klarna, and checks your identity and creditworthiness under its own responsibility, including with the help of credit reference agencies. Klarna's privacy policy applies to this.
TWINT AG, Switzerland, Apple and Google receive the data needed for the payment if you pay with TWINT, Apple Pay or Google Pay, and process it in accordance with their own terms. So that the Google Pay button can be displayed, your browser loads a script from Google on the checkout page. Google receives your IP address in the process.
Hostinger operates our website on servers in the European Union and sends the shop's e-mails.
Google operates the e-mail address info@gamesandmore.ch for us (Google Workspace). Messages to us are stored there. The provider is a Google group company based in Ireland, and data may also be processed in the USA.
OpenAI Ireland Ltd., Ireland, identifies products from the texts you enter in the buyback form and helps us describe photos of our items. OpenAI also processes the data in the USA and, according to its own information, stores it for no more than 30 days.
Google Translate. If you choose a different language yourself on a page without its own translation, your browser loads a script from Google for as long as this choice is stored. Google receives your IP address and the text of the page in the process.
For address suggestions at checkout, we query the street name and postcode from public interfaces, namely the Federal Office of Topography swisstopo and OpenPLZ, without your name or any other details.
Data is also received by banks through which we process payments and payouts, by authorities if required by law or if there is a suspicion of a criminal offence, and by professionals such as accountants or legal advisers who are bound by confidentiality.
10. Disclosure abroad
Some service providers process data outside Switzerland, mainly in the European Union and the USA. According to the Federal Council, the states of the European Union and the European Economic Area have an adequate level of data protection. For the USA, this only applies to companies certified under the Swiss-U.S. Data Privacy Framework. For other recipients, we rely on standard contractual clauses recognised by the Federal Data Protection and Information Commissioner (FDPIC), or on an exception under Art. 17 FADP, for example where the disclosure is necessary for the performance of your contract.
11. Retention
We only keep data for as long as is necessary for the purpose or required by law. We keep order, invoice and buyback data for ten years (Art. 958f CO). We delete buyback requests without a completed purchase, repair requests without an order and messages without a contract after twelve months. We delete account data when you have your account deleted, unless a retention obligation prevents this. We delete the visitor count after two years.
12. Data security
The website can only be accessed in encrypted form via HTTPS. We take appropriate technical and organisational measures to protect your data against unauthorised access, loss and misuse. Within our business, payment and bank details are only seen by people who need them for their tasks. We delete data on devices we have bought using a secure method before we resell the devices.
13. Persons in Liechtenstein and the European Economic Area
For persons in Liechtenstein and the rest of the European Economic Area, the GDPR also applies insofar as we offer them goods or monitor their behaviour on our website. We base the processing on the performance of the contract and pre-contractual measures (Art. 6(1)(b) GDPR), on legal obligations (Art. 6(1)(c) GDPR), on our legitimate interest in operating the shop securely and efficiently and in preventing fraud (Art. 6(1)(f) GDPR) and, where we ask you for it, on your consent (Art. 6(1)(a) GDPR). According to the European Commission, Switzerland has an adequate level of data protection. You have the rights under Art. 15 to 22 GDPR and can lodge a complaint with the Liechtenstein Data Protection Authority (Datenschutzstelle Liechtenstein).
14. Your rights
You can request information on whether we process data about you and, if so, which data. You can have incorrect data corrected and have data deleted, unless there is an obligation to retain it. You can request that your data be handed over to you in a common electronic format. You can object to processing, and in particular you can object to advertising at any time. You can withdraw consent at any time with effect for the future. To do so, write to us at info@gamesandmore.ch. We reply within 30 days. For security reasons, we may ask for proof of your identity. You can also lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC) in Bern.
15. Automated decisions and profiling
Our system automatically calculates the instant price on the Sell page from your details. For devices on our list, the starting value comes from a fixed price table, and for texts you enter yourself, from the AI service's estimate described in section 4. Fixed rules then apply. The instant price is a maximum price. We only decide whether to buy a device, and at what price, after a person has checked the device. You can ask at any time for a person to look at your details and make you an individual offer.
If you pay with Klarna, Klarna decides according to its own rules whether this payment method is available to you.
We do not create profiles about you.
16. Social networks
We do not embed content from social networks. A link to a social network opens its website. Only then does the provider receive data from you, in accordance with its own terms.
17. Changes
We update this privacy policy when our processing or the law changes. The version currently published here applies.
