Terms and Conditions

1. Scope

These General Terms and Conditions (AGB) apply to all contracts between you and Migliore Games and More, sole proprietorship, owner Vincenzo Migliore, Juraweg 4, 5043 Holziken, Switzerland. They apply to purchases in the online shop gamesandmore.ch and, by arrangement, in Holziken, to the buyback of devices (section 13), to repairs (section 14) and to gaming PCs (section 15). For consumers domiciled in Liechtenstein, section 20 also applies.

We sell in normal household quantities. We may refuse orders for commercial resale. Different terms only apply if we confirm them in writing. If a provision is invalid, the other provisions remain valid.

2. Contact

You can reach us by e-mail at info@gamesandmore.ch or by post at the address in section 1. We are an online shop with no retail premises. A visit to Holziken is only possible by arrangement.

3. Ordering and conclusion of the contract in the online shop

The items in the shop are not a binding offer from us, but an invitation to place an order with us.

This is how an order works. You add one or more items to the basket and go to the checkout. There you enter your e-mail address and your address and choose the payment method. Before you submit the order, you see a summary of all items, their condition, the shipping costs and the total price. There you can check and correct all details, remove items or cancel the order. By clicking the button to order and pay, you make a binding offer to buy the items in your basket.

Immediately afterwards, you receive an e-mail confirming receipt of your order. This confirmation of receipt is not yet an acceptance of your offer. Charging or reserving the amount on your payment method is not an acceptance either. The purchase contract is concluded when we dispatch the goods and send you the shipping confirmation, or when we hand them over to you in Holziken.

You are bound by your offer for five working days. If we do not accept it within this time, we refund any amounts already paid immediately and in full.

We store the text of the contract. You receive the Terms and Conditions as a PDF with the confirmation of receipt. You can view and save them at any time at gamesandmore.ch/agb. The language of the contract is German. Translations of these Terms and Conditions are for your convenience, the German version is binding.

4. Availability, pricing errors and technical errors

Every used item is unique. It can happen that an item was sold elsewhere shortly before your order, or that we notice a difference from the description during the final check before dispatch. In that case, we contact you. You decide whether you still want the item, or we refund the amount for it immediately.

Until we accept an order, we may refuse it, in particular in cases of obvious errors in the price or description, technical faults in or manipulation of the shop, orders placed using automated programs and reasonable suspicion of misuse. In this case, we refund any amounts already paid in full.

If we have already accepted an order despite an obvious pricing error, the statutory provisions on error apply (Art. 23 et seq. CO). We will then contact you immediately. You can keep the item at the correct price or receive a full refund of the amount you paid.

We may deliver an order in several shipments. This does not result in any additional shipping costs for you.

5. Prices

All prices are final prices in Swiss francs per item. We are not entered in the register of persons liable for VAT and therefore do not show any VAT. You can see the shipping costs on the product page, in the basket and in the summary before you submit your order. The price that applies is the one shown in the shop at the time of your order.

6. Payment

You pay in advance through our payment service provider Stripe by credit or debit card, TWINT, Apple Pay, Google Pay or Klarna. The payment data is processed by the payment service provider. We do not receive full card details. If you pay with Klarna, Klarna's terms also apply, and Klarna decides itself whether this payment method is available to you.

7. Shipping, delivery and transport risk

We ship with Swiss Post to Switzerland and Liechtenstein, and every shipment is tracked. As a rule, we hand the shipment over to Swiss Post within one working day of receiving payment. Swiss Post usually delivers within one to three working days. These are guide values, not guaranteed dates. Shipping is free from an order value of CHF 70. Below that, the shipping costs shown in the basket apply.

We bear the risk of loss or damage in transit until the shipment reaches you. If a parcel is damaged, please let us know as soon as possible, with photos, so that we can report the damage to Swiss Post.

If a shipment cannot be delivered because an incorrect address was given, we will contact you. In this case, you bear the costs of sending it again.

8. Used items and condition

A large part of our range consists of used items. Every used item is unique and is sold in the condition described and photographed on the product page. The photos show the actual item and form part of the description.

We describe the condition with two indicators. Completeness shows whether a game is loose, with its original box, complete in its original box or new and sealed. For devices, the grade describes the appearance, from Like new through Very good to Good. Signs of use that match the stated grade are not a defect. You will find all the details under Condition.

Every used item is checked, cleaned and function tested before it is sold. We do not open new and sealed items, so we do not test their function. New and sealed items are considered new. We only sell devices as Refurbished if their replacement parts are original parts and their battery still has at least 95 per cent of its original capacity on delivery. We reset every device we sell to its factory settings before selling it.

9. Download codes and online services

Many games for current consoles originally included a download code, for example for additional content, a season pass, online multiplayer or a digital version. With used games, such a code may already have been redeemed by the previous owner or may have expired. We do not check enclosed codes and do not warrant that they are valid. A valid code is therefore not part of the agreed characteristics of the item. What you buy is the physical medium with the game. We point this out clearly on the product page of every item concerned.

Manufacturers' online services such as Nintendo Switch Online, PlayStation Plus or Xbox Game Pass are not part of the purchase. They are subject to the terms of the respective provider.

10. Statutory warranty

The statutory warranty under Art. 197 et seq. CO applies to all items. It applies independently of our warranty under section 11.

For new items, including new and sealed ones, claims become time-barred two years after delivery. For used and Refurbished items, we shorten this period to one year after delivery, as permitted by Art. 210 para. 4 CO. For consumers in Liechtenstein, section 20.4 applies.

Please check the goods soon after you receive them. Report any defect to us immediately after discovering it, by e-mail to info@gamesandmore.ch, with the order number, a short description and, if possible, photos or a video. Please do not send anything back unannounced.

If there is a defect, we first remedy it, at our choice, by repair or by replacement with an equivalent item. If this does not succeed within a reasonable time, or if we refuse to do so, you can demand rescission of the purchase or a price reduction as provided by law. If the defect claim is justified, we bear the costs of shipping, repair and replacement.

Signs of use that match the stated grade, a download code that has already been redeemed or has expired, and the normal decrease in battery capacity after delivery are not defects.

11. Our 12-month warranty

In addition to the statutory warranty, we give you a 12-month warranty from the delivery date on every item you buy from us. The warranty is voluntary and free of charge and does not limit your statutory rights. It applies to deliveries to Switzerland and Liechtenstein.

The warranty covers functional defects that occur during the warranty period and are not due to improper use. We remedy them, at our choice, by repair, replacement with an equivalent item or a refund of the purchase price.

The warranty does not cover normal wear and tear, damage caused by drops, pressure, liquid, heat or cold, damage caused by your own repair attempts or by work done by third parties, or the normal ageing of wear parts such as rechargeable and other batteries. Cosmetic signs of use that correspond to the stated grade are not covered by the warranty.

To make a warranty claim, write to us at info@gamesandmore.ch with your order number and a short description. We will get back to you within 48 hours with the next steps. We cover the shipping costs for valid warranty claims. The warranty is provided by Migliore Games and More, Juraweg 4, 5043 Holziken.

12. Voluntary 30-day right of return

For orders delivered to Switzerland, there is no statutory right of withdrawal. We voluntarily grant you a right of return of 30 days from receipt of the goods, without having to give reasons. For consumers in Liechtenstein, the statutory right of withdrawal under section 20 also applies.

Notify us of the return within 30 days by e-mail to info@gamesandmore.ch with your order number and the items you want to return. We confirm the return and give you the address. Send the item back complete, undamaged and in the same condition in which you received it, with its packaging and accessories. Before doing so, sign out of all accounts you have set up on a device. You bear the costs and the risk of the return shipment.

Once we have received and checked the item, we refund the purchase price within ten working days using the same payment method.

We do not take back sealed items whose seal was removed after delivery, items that were damaged or altered after delivery, repairs and gaming PCs built to your specifications. This does not affect your rights in the event of defects.

13. Buyback of devices

13.1 Who can sell

You can sell us devices if you are at least 18 years old. If you are younger, we need the written consent of your parents or your legal representative. By submitting the form, you confirm that the device belongs to you, that you are entitled to dispose of it and that it has not been stolen, lost or otherwise unlawfully acquired. We may ask you to prove your identity.

13.2 The instant price

On the Sell page, we calculate an instant price from your details. For devices on our list, the starting value comes from a fixed price table. For details you enter yourself, such as game titles or a model, an AI service identifies the product and estimates its current market value in Switzerland. Our system then calculates the price according to fixed rules. We show you the products we have identified before you submit. Please check that they are correct.

The instant price is a maximum price. It is valid until the date shown and only if the device matches your details. If an instant price is obviously based on an incorrect identification of the product or on a technical error, we are not bound by it. We will then contact you with a corrected offer, and you decide whether you want to sell.

13.3 Process and conclusion of the contract

By submitting the form, you make us an offer to sell us the device at the instant price shown. If there is no instant price, we send you an offer within 24 hours. You receive an e-mail with your details, the price and the shipping label. This e-mail is not yet a purchase contract.

Once the device arrives, we check it. If it matches your details, we accept your offer, confirm this to you by e-mail and transfer the amount within 48 hours of the check. Only then is the purchase contract concluded.

If the condition or technical details differ from what you stated, we send you a new offer. You have 14 days to accept or reject it. If you reject it or do not reply within this period, we send the device back to you free of charge.

Until we have accepted your offer, you can cancel the sale at any time. If you have already sent the device, we send it back to you free of charge.

13.4 Sending the device

For shipping, you receive a free Swiss Post shipping label from us. Pack the device well, with its power supply and cables. If a parcel sent with our shipping label is demonstrably lost or damaged on its way to us, we pass Swiss Post's compensation on to you, up to the price we confirmed to you. Without an additional service, Swiss Post is liable for a maximum of CHF 500. If your device is worth more, write to us before sending it. We will then send you a shipping label with higher liability.

13.5 Payout

We transfer the amount to a bank account in Switzerland or Liechtenstein held in your name. We do not pay out cash.

13.6 Locks and data

Before sending, sign out of iCloud, your Google account and all other accounts, remove any locks and reset the device to its factory settings. We cannot buy a locked device and will send it back to you. If any data still remains on the device, we delete it using a secure method without looking at it. So back up anything you want to keep beforehand.

13.7 Suspicion of a criminal offence

If there are indications that a device was stolen or unlawfully acquired, we make no payment, inform the police and hand the device over to them. If a device we have bought later has to be handed over to a person entitled to it, you repay us the amount you received (Art. 192 et seq. CO). You are liable under the law for defects that you knew about and concealed from us.

13.8 Devices that cannot be sent back

If a device that we do not buy cannot be sent back, for example because the address is wrong or you do not collect the shipment, we keep it for six months. After that, following a final reminder by e-mail with a 30-day deadline, we may sell or otherwise dispose of it. On request, we pay you any proceeds less our costs.

14. Repairs

14.1 Diagnosis and fixed price

The diagnosis is free of charge. After the diagnosis, we give you a fixed price for the repair (Art. 373 CO). Our quote also states whether we will fit an original part or a compatible part. We only carry out the repair once you have confirmed the quote. If we find another fault during the repair, we ask you before doing any more work. If you decline the repair, we send the device back to you or you collect it in Holziken by arrangement.

14.2 Your data

Back up all data on the device before the repair. Some repairs require the device to be reset. We only access your data to the extent necessary for the repair and testing, and we do not pass it on. We are only liable for data loss in the case of intent or gross negligence.

14.3 Statutory warranty and our warranty

The statutory warranty for contracts for work and services applies to the repair (Art. 367 et seq. CO). Claims become time-barred two years after the device is handed back to you. In addition, we give you a 12-month warranty on the repair carried out and the parts fitted, from the date the device is handed back to you. If the same fault recurs during this period or a fitted part fails, we fix it free of charge. New damage caused by drops or liquid and work by third parties after our repair are excluded.

14.4 Payment, collection and uncollected devices

You pay the price as invoiced by us before we send the device back, or on collection. Until outstanding amounts have been paid, we may retain the device (Art. 895 CC). When the repair is finished or if you have declined it, we inform you by e-mail. Then collect the device within 30 days or have it sent to you.

If you do not collect the device within six months despite two reminders by e-mail and by letter, we may realise it after a final period of 30 days, that is, sell it or dispose of it properly once all data has been deleted. We offset any proceeds against outstanding amounts and our costs. We pay any surplus to you.

15. Gaming PCs

We put together a gaming PC according to your wishes and your budget. You receive a written quote. The contract is concluded when you accept the quote within the stated period and we confirm the order. Before handover, we test the PC under load.

The quote states whether a component is new or used. New components are covered by the statutory warranty of two years from handover, used components by one year. We pass on manufacturers' warranties to you. Because the PC is built to your specifications, it is excluded from the voluntary right of return.

16. Liability

We are liable without limitation for damage we cause intentionally or through gross negligence, for personal injury and under the Product Liability Act. In the case of slight negligence, to the extent permitted by law, we are only liable for direct damage and not for indirect damage or loss of profit. Your rights under the statutory warranty and our warranty remain unaffected.

17. Use of the website

The texts, photos and graphics on this website are protected by copyright. Copying them is only permitted with our written consent. Using programs to automatically read out the website, the product data or the price calculation on the Sell page is not permitted.

18. Data protection

How we process personal data is explained in our privacy policy.

19. Old electrical devices

We take back devices of the type we sell free of charge, even if you did not buy them from us and do not buy anything new. You will find the details under Shipping and returns.

20. Additional provisions for consumers in Liechtenstein

If you have your domicile or habitual residence in Liechtenstein and buy from us as a consumer, the following provisions also apply. They take precedence over the rest of these Terms and Conditions to the extent that they are more favourable to you. In any event, the mandatory provisions of Liechtenstein law that protect you remain unaffected.

20.1 Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you receive several items from one order separately, the period starts when you receive the last item.

To exercise your right of withdrawal, you must inform us, Migliore Games and More, Juraweg 4, 5043 Holziken, Switzerland, e-mail info@gamesandmore.ch, of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an e-mail. You may use the model withdrawal form in section 20.7 for this, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

20.2 Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we received your notice of withdrawal. This does not include the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

20.3 Exceptions and services

The right of withdrawal does not apply to audio or video recordings and computer software, including video games, supplied in sealed packaging if the seal has been removed after delivery. Nor does it apply to goods that are made to your specifications or are clearly tailored to your personal needs.

For repairs, the withdrawal period runs from the day the contract is concluded. If you want us to start the repair before the period expires, you need to confirm this to us expressly. If you withdraw after that, you owe us a proportionate amount for the services provided up to that point. Once the repair has been fully carried out, your right of withdrawal lapses if you expressly agreed to this and confirmed that you are aware that you lose it as a result.

20.4 Statutory warranty

The Liechtenstein Consumer Warranty Act (KonsGG) applies to you. The statutory warranty period is two years from handover, including for used items. The reduction to one year under section 10 does not apply to you. If a defect becomes apparent within one year of handover, it is presumed to have existed at the time of handover. If there is a defect, you can first demand repair or replacement and, if this is not possible or does not succeed, a price reduction or rescission of the contract.

20.5 Relationship with the voluntary right of return

Our voluntary 30-day right of return under section 12 also applies to you. If you withdraw within the statutory period of 14 days, the rules in sections 20.1 and 20.2 apply, in particular the reimbursement of the costs of standard delivery within 14 days of your notice of withdrawal.

20.6 Place of jurisdiction

Legal action against you can only be brought before the Princely Court of Justice (Fürstliches Landgericht) in Vaduz. Any other mandatory places of jurisdiction available to you under Liechtenstein law remain unaffected.

If you wish to withdraw from the contract, please complete and return this form.

21. Applicable law and place of jurisdiction

Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers in Liechtenstein, section 20 also applies.

The place of jurisdiction is Holziken. After the conciliation proceedings before the Justice of the Peace office, district IX (Friedensrichteramt Kreis IX) in Unterkulm, the District Court of Kulm (Bezirksgericht Kulm) in Unterkulm has jurisdiction. If you are a consumer domiciled in Switzerland, you can also bring an action at your place of domicile, and we can only sue you at your place of domicile (Art. 32 CPC).

22. Changes

We may amend these Terms and Conditions. An order is always governed by the version published at the time of the order.
